Sunset Boat Party Event Terms and Ticket Policy

1. Organizer and agreement

These Event Terms and Ticket Policy (“Terms”) apply to the Sunset Boat Party (“Event”) organized by Foundation for Community Language and Arts, Inc. (“Foundation,” “we,” “us,” or “our”). Questions and notices may be sent to admin@foundationclarts.org.

The purchaser accepts these Terms for the ticket order. Every attendee must separately accept and sign the Participant Assumption of Risk, Waiver and Release and the Media Consent, License and Release before attending. A purchaser cannot sign either personal agreement for another adult.

2. Event details

The vessel may leave without late attendees. Failure to arrive, check in, complete required documents, or board on time does not entitle the purchaser or attendee to a refund except where required by law.

3. Age and identification

The Event is limited to people who are at least 18 years old at boarding. Each attendee must present current, valid government-issued photo identification at check-in. An attendee who cannot establish eligibility may be denied boarding without a refund except where required by law. The Foundation does not need or request a copy of the identification through the ticket or legal-document process. Only attendees 21 years of age or older with valid government-issued photo identification may purchase, possess, or consume alcohol.

4. Tickets, orders, and check-in

The purchaser is responsible for the accuracy of the order and for giving these Terms and all attendee documents to every person in the group. The number of people admitted cannot exceed the quantity of valid tickets associated with the Foundation order reference.

Tickets and order references may not be reproduced, copied, altered, counterfeited, duplicated, used for more than one admission, or resold commercially without the Foundation’s written authorization. The Foundation may reject a ticket or transfer that reasonably appears fraudulent, duplicated, altered, or unauthorized. Unauthorized reproduction, counterfeiting, fraud, or misuse may also result in cancellation, removal, referral to law enforcement, or other legal action as permitted by law.

5. Prices, reservations, and payment

Ticket prices are shown in U.S. dollars. Card reservations and payments are made through the official Event page. An authorized System Manager may also create a one-person admission after receiving the full cash price or may issue a documented courtesy invitation at no cost. A cash admission is completed when the Foundation records the payment and issues its receipt; a courtesy admission is completed when the authorized invitation is recorded. Staff-issued admissions consume Event capacity and cannot contain or imply a Stripe payment. The Foundation does not receive or store complete card numbers or card-verification codes in its Event records.

Every cash receipt identifies the admission price, subtotal, separately stated sales tax, total collected, payment time, and Foundation business address. A courtesy invitation has a zero total and states that no payment is due. The recipient of either staff-issued admission must personally accept these Terms and every required attendee document before a boarding pass is created.

6. Customer cancellations, no-shows, and removals

For a customer-initiated cancellation received on or before August 31, 2026, a 50% cancellation penalty applies, meaning 50% of the ticket purchase price is retained and 50% is refundable, except where applicable law requires a different result. For a customer-initiated cancellation received after August 31, 2026, a 100% cancellation penalty applies and the ticket purchase price is non-refundable except where required by law. Transfer requests must be received at admin@foundationclarts.org by 6:00 PM Eastern Time on September 9, 2026 and are effective only after written confirmation. Organizer cancellation results in a ticket-price refund; following rescheduling, purchasers have seven calendar days after notice to request a refund instead of carrying the ticket to the replacement date.

Approved card refunds are returned through the payment processor. An approved cash refund is completed outside Stripe and is recorded by authorized staff with the delivery method, completion time, processor, and reference or evidence. Revoking a courtesy invitation creates no refund because no payment was collected.

No refund is owed for a no-show, late arrival, missed boarding, failure to present valid identification, failure to complete required attendee documents, ineligibility, or removal or denied boarding resulting from an attendee’s violation of these Terms or safety instructions, except where required by law.

Nothing in these Terms limits a right or remedy that cannot legally be limited.

7. Ticket transfers

A purchaser may request a transfer by emailing admin@foundationclarts.org. The request must be received no later than 6:00 PM Eastern Time on September 9, 2026 and must include the order reference, purchaser name and email, and replacement attendee’s full name and email.

A transfer is not effective until the Foundation confirms it in writing. The replacement attendee must be 18 or older, present valid government-issued photo identification, and personally accept and sign every required attendee document. The Foundation may deny incomplete, late, fraudulent, commercial-resale, or safety-related transfer requests. A transfer does not increase ticket quantity or create a refund right.

8. Cancellation or rescheduling by the Foundation

If the Foundation cancels the Event and does not reschedule it, the Foundation will refund the ticket purchase price to the original payment method. Unless required by law, the Foundation is not responsible for transportation, lodging, parking, lost wages, or other incidental or consequential expenses.

If the Foundation reschedules the Event, the ticket automatically applies to the replacement date. The purchaser may instead request a refund by emailing admin@foundationclarts.org within seven calendar days after the Foundation sends the rescheduling notice. A timely approved request will be refunded to the original payment method.

9. Operational and safety changes

Weather, water conditions, governmental action, mechanical issues, medical events, security concerns, instructions from the captain or crew, or other safety and operational circumstances may require reasonable changes to the vessel, boarding procedure, route, schedule, entertainment, food or beverage availability, or Event activities.

The Foundation will provide notice of a material change when reasonably practicable. A safety-driven or non-material operational change is not itself a cancellation or rescheduling. This section does not authorize retroactive changes to paid ticket prices or remove any remedy required by law.

10. Conduct and prohibited items

Attendees must act safely and respectfully and must follow lawful safety and operational instructions from the captain, crew, venue personnel, security personnel, emergency responders, and authorized Foundation representatives. The following are prohibited:

• fighting, threats, rough play, hazing, harassment, discriminatory abuse, or unwanted contact;
• profanity or obscene language;
• conduct that endangers or materially interferes with another person;
• firearms, weapons, explosives, dangerous chemicals, or other hazardous items;
• illegal drugs, controlled substances possessed without lawful authority, or unlawful activity;
• smoking or vaping of any kind, including electronic cigarettes;
• bringing outside food or alcohol;
• dangerous intoxication, furnishing alcohol to an ineligible person, or violating alcohol-service requirements;
• tampering with safety, navigation, security, or emergency equipment; and
• failure to follow specific Event safety requirements or lawful emergency instructions.

An attendee may be refused admission or removed when reasonably necessary for safety, compliance, or protection of people or property. Law enforcement or emergency services may be contacted when appropriate.

11. Alcohol, food, and health

Food and beverages may be offered or sold by third parties and remain subject to availability and operator rules. Alcohol service is controlled by the licensed provider, which may refuse service. Each attendee is responsible for drinking responsibly and arranging safe transportation after the Event.

An attendee with a medical, mobility, dietary, or accessibility concern should contact admin@foundationclarts.org as early as possible. The Foundation will communicate requests but cannot promise a particular accommodation that is outside its control. Nothing in these Terms requires disclosure of detailed medical information by email.

12. Personal property

Attendees are responsible for their personal property. To the fullest extent permitted by law, the Foundation is not responsible for ordinary loss, theft, or damage to personal property that is not caused by the Foundation’s legally actionable conduct. Items should not be left unattended.

13. Third-party services

The venue, vessel, vessel operator, payment processor, security providers, food and beverage providers, photographers, and other vendors may be independent third parties unless a written agreement states otherwise. The Foundation does not control every third-party act or service and does not represent that it is the agent of a third party. This section does not broadly incorporate a separate student handbook, school policy, or unspecified third-party rulebook into these Terms.

14. Assumption of risk and separate waiver

A recreational vessel event involves inherent risks. Every attendee must read and sign the separate Participant Assumption of Risk, Waiver and Release. These Terms do not independently waive liability that cannot legally be waived.

15. Photography and required media consent

Photography, video, and audio recording are planned at the Event. As a stated condition of attendance, each attendee must separately sign the Media Consent, License and Release. The separate document controls permitted promotional and other uses of an attendee’s name, image, likeness, and voice.

16. Privacy

The Event Privacy Notice describes how purchaser, attendee, transaction, signature, security, and media information is handled. By purchasing or attending, a person acknowledges receipt of that notice. Acknowledgment of the notice is not consent to processing where applicable law requires a separate consent.

17. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except to the extent another law must apply. Subject to applicable law, disputes relating to these Terms will be brought in a state or federal court located in New York County, New York. These Terms do not include an arbitration agreement or class-action waiver.

18. Severability, non-waiver, and changes

If a provision is held unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue where legally permitted. A failure to enforce a provision once is not a waiver of later enforcement.

The Foundation may reasonably modify these Terms when further review, applicable law, safety, or Event operations require a change. Any modification will be made in good faith and within reason in relation to the Event. The Foundation will retain the version accepted by the purchaser with the order record and will provide notice of a material change when reasonably practicable.

19. Entire ticket agreement and contact

These Terms, the order confirmation, and any policies expressly incorporated herein form the ticket agreement between the purchaser and the Foundation, subject to applicable law. No separate organizational documents, policies, or other agreements are incorporated unless expressly stated herein. Questions, transfer requests, rescheduling refund elections, privacy requests, and legal notices may be sent to admin@foundationclarts.org.

20. Purchaser acknowledgment

By signing physically or electronically, the purchaser confirms that the purchaser:

• is legally competent to agree to these Terms;
• has reviewed the Event details, 18+ requirement, customer cancellation policy, transfer policy, and attendee-document requirements;
• understands that card reservations use the official Event page and that authorized staff may separately record a completed cash payment or documented courtesy invitation;
• will provide the documents to every attendee in the order; and
• understands that every attendee must personally complete the waiver and mandatory media consent before admission; and
• confirms that, before signing, the contents, significance, and legal effect of this agreement have been fully explained to the purchaser in English or, if needed for the purchaser’s understanding, in the purchaser’s first or native language. The purchaser confirms having read these Terms and the related ticket policies, understanding their scope and effect, having had an opportunity to ask questions and seek independent advice, and voluntarily accepting and agreeing to be bound by them in connection with the purchase and participation in the Event.
