Sunset Boat Party Event Privacy Notice
1. Who this notice covers
This Event Privacy Notice explains how Foundation for Community Language and Arts, Inc. (“Foundation,” “we,” “us,” or “our”) handles personal information relating to purchasers and attendees of the Sunset Boat Party. Privacy questions and requests may be sent to admin@foundationclarts.org.
2. Event details and related ticket policy
- Date: Friday, September 11, 2026
- Event hours: 6:00 PM–11:00 PM Eastern Time
- Check-in opens: 5:30 PM; boarding begins: 6:00 PM; scheduled departure: 7:00 PM
- Venue: Pier 83, Circle Line, West 42nd Street and 12th Avenue, New York, NY 10036
- Organizer: Foundation for Community Language and Arts, Inc.
- Minimum age: 18 at boarding with valid government-issued photo identification; only attendees 21 or older with valid government-issued photo identification may purchase, possess, or consume alcohol
For a customer-initiated cancellation received on or before August 31, 2026, a 50% cancellation penalty applies, meaning 50% of the ticket purchase price is retained and 50% is refundable, except where applicable law requires a different result. For a customer-initiated cancellation received after August 31, 2026, a 100% cancellation penalty applies and the ticket purchase price is non-refundable except where required by law. Transfer requests must be received at admin@foundationclarts.org by 6:00 PM Eastern Time on September 9, 2026 and are effective only after written confirmation. Organizer cancellation results in a ticket-price refund; following rescheduling, purchasers have seven calendar days after notice to request a refund instead of carrying the ticket to the replacement date.
3. Information we collect
Depending on a person’s relationship to the Event, the Foundation may collect:
- purchaser and attendee full name;
- email address and telephone number;
- language preference and source page;
- self-declared age band (18–20 or 21+) for the Event date;
- ticket tier, quantity, amount, currency, order reference, and order status;
- admission method; Stripe Checkout and payment-reference identifiers when applicable; cash receipt amount, time, and refund evidence; courtesy reason and approving staff member; payment/refund status; and transaction timestamps;
- ticket-transfer request and replacement attendee information;
- signed-document ID, version, language, signature or affirmative-assent evidence, timestamp, and related audit information;
- communications, support requests, accommodation requests, and incident reports;
- IP address and limited request, device, security, rate-limit, and fraud-prevention information; and
- photographs, video, audio, name, voice, and likeness covered by the separate Media Consent, License and Release.
We do not collect a home address, copy of government identification, full birth date, or detailed medical information through the legal-document process.
4. Payment information
Stripe processes card and payment-method information through Stripe-hosted Checkout. The Foundation does not receive or store complete payment-card numbers, card-verification codes, or payment-method/card details in its Event order records. For a staff-recorded cash admission, the Foundation records the amount, receipt reference, collection time, staff member, and any later refund evidence. A courtesy invitation records its stated reason, approving System Manager, and zero amount due.
Stripe handles information under its own terms and privacy practices. The Foundation receives limited identifiers and transaction results needed to create the order, reconcile payment, address refunds and disputes, prevent fraud, and maintain accounting records.
5. How we use information
The Foundation may use Event information to:
- provide availability and create, authorize, confirm, receipt, transfer, reconcile, and support online, cash, and courtesy admissions;
- confirm attendee eligibility and required documents;
- use the self-declared age band as a visible boarding and alcohol-control cue while still requiring staff to verify valid government-issued photo identification;
- operate check-in, boarding, safety, accessibility, and Event administration;
- process customer communications, cancellations, rescheduling elections, refunds, disputes, and chargebacks;
- detect duplicate requests, abuse, fraud, security incidents, and unlawful activity;
- document consent, compliance, incidents, and legal claims;
- comply with tax, accounting, insurance, court, governmental, and legal obligations;
- protect attendees, staff, contractors, the vessel, and property; and
- create and use Event media as authorized by the separate signed media agreement, including promotional, educational, informational, advertising, commercial, and other uses within the scope of that written consent.
We will not use the information for an incompatible purpose without providing additional notice or obtaining consent where required by law.
6. How we share information
The Foundation may share only reasonably necessary information with:
- Stripe and payment, refund, dispute, and fraud-prevention providers when applicable to the admission method;
- Frappe, database, hosting, static-site, network, security, and technical-service providers;
- Circle Line Sightseeing Yachts, Inc., Circle Line, venue personnel, crew, security, check-in, accessibility, emergency, and other Event contractors;
- authorized photographers, videographers, media-production, hosting, printing, and distribution providers under the media agreement;
- accountants, auditors, insurers, brokers, attorneys, and other professional advisers;
- a successor in a lawful organizational transaction subject to appropriate protections; and
- courts, regulators, law enforcement, emergency responders, or other parties when required by law or reasonably necessary to protect rights, safety, or property.
The Foundation does not sell Event personal information as a standalone data product or use it for unrelated cross-context behavioral targeting. The separate written Media Consent, License and Release may, however, authorize advertising, commercial, and trade uses of a participant’s name, likeness, image, or voice within the scope of that consent.
7. Media and public disclosure
The separate Media Consent, License and Release governs planned recording and authorized promotional, educational, informational, advertising, commercial, and other media uses. Authorized media may be published publicly and may remain in reports, websites, social media, advertisements, commercial materials, archives, print materials, or third-party caches and reposts.
Media consent is mandatory for attendance. This privacy notice does not itself grant media rights.
8. Retention
The Foundation retains information only as long as reasonably necessary for the purposes described above, including Event administration, accounting and tax obligations, refund and dispute periods, insurance requirements, security, document enforcement, legal claims, and organizational archives.
Retention varies by record type under the Foundation’s documented retention schedule. Payment and order records, signed legal-document evidence, incident records, security logs, support communications, and published media do not necessarily have the same retention period. Where deletion is legally permitted and operationally feasible, information will be deleted, de-identified, or securely archived after the applicable period.
9. Security
The Foundation uses reasonable administrative, technical, and organizational safeguards appropriate to the information and risk, including restricted administrative access, server-created Stripe sessions, signed webhook verification, minimized Event records, and separation of card processing from the Event website.
No storage or transmission method is completely secure. This notice does not guarantee that a security incident cannot occur. Suspected Event-data incidents should be reported to admin@foundationclarts.org.
10. Choices and requests
Subject to identity verification, applicable law, and legal-retention requirements, a purchaser or attendee may ask to:
- access or receive information the Foundation maintains about that person;
- correct inaccurate contact or attendee information;
- request deletion of information no longer required;
- ask how information was used or shared; or
- raise a privacy concern.
Requests may be sent to admin@foundationclarts.org. The Foundation may need the requester’s name, order reference, email address, and enough additional information to verify the request. The Foundation does not request a full identification copy unless it is necessary and a secure process is provided.
Media rights and withdrawal limitations are addressed by the separate Media Consent, License and Release. A privacy request may not require removal of information that must be retained by law, for a dispute, for safety, or to establish or defend legal claims.
11. Adults only
The Event and its ticketing flow are intended only for people aged 18 or older. The Foundation does not knowingly offer Event admission to children. If information about an ineligible person is submitted, contact admin@foundationclarts.org.
12. International and third-party processing
Some service providers may process or store information outside New York or outside the attendee’s home jurisdiction. The Foundation maintains the applicable vendor arrangements, contractual protections, and legally required disclosures.
Third-party websites and services, including Stripe and map links, maintain their own privacy notices. The Foundation is not responsible for an unrelated third party’s independent privacy practices.
13. Changes to this notice
The Foundation may update this notice to reflect approved operational, legal, security, or vendor changes. The current notice will identify its effective date and version. A material change will not retroactively expand a signed media license or reduce a paid purchaser’s rights without additional notice or consent when required by law.
The version provided at purchase and signature should be retained with the related audit record.
14. Participant acknowledgment
By signing below, I acknowledge that I have received and reviewed this Event Privacy Notice and understand how the Foundation for Community Language and Arts, Inc. may collect, use, disclose, retain, and protect personal information relating to the Event. I understand that my signature acknowledges receipt and review of this notice and does not constitute consent to any processing activity for which applicable law requires separate affirmative consent.
